Ghariani says Sharia as basis of legislation in Dialogue Draft “not enough”

The Dar Al-Ifta, the fatwa organisation run by Sheikh Sadik Al-Ghariani, has ruled that the supposedly final version of the UN Dialogue Draft agreement cannot be accepted until it changes its stand on the Sharia.

Article 5 of the Governing principles says there is a “Commitment that Islamic law (Sharia) is the source of legislation; it shall not be permissible to issue any legislation that contradicts with it”.

This was not enough, the Dar Al-Ifta said, indicating that it required Sharia to be the law rather than the source of the law.

It was responding to a letter from a group of members of the General National Congress in Tripoli who wanted to know if the Draft and the dialogue were Islamically compliant.

 

The fatwa body also said that the draft had to demonstrate equality and balance between all sides in Libya, suggesting that at present it did not. It also said that the notion of “terrorism which is included in the draft” needed to be clearly explained. Additionally it said that “coup-makers should be excluded from working in military and security offices” – seen as a reference to Khalifa Hafter and his associates.
